P&Z Commission rejects garage's application

The Planning and Zoning Commission this week rejected an application regarding the controversial “Midtown Garage” property, saying it was incomplete.

In a unanimous decision on Monday, June 2, the commission voted to deny receipt of an application by Weston I, LLC, seeking to operate an automobile repair facility at 107 Georgetown Road.

James Pjura, the town’s zoning enforcement officer, said the application was submitted without a plot plan, wetlands survey, and other items as required by the town.

The town of Weston has pending litigation with Weston I, LLC. In 2007, the commission denied an application for the operation of a garage facility at the same property on the grounds that the property’s commercial use had been abandoned, and the property had reverted to residential use.

For years, a gas station known as Midtown Garage occupied the premises. But in recent years, there has been no overt sign of activity on the property, and neighbors have called it “an eyesore.”

On March 31, the court dismissed an administrative appeal filed by Weston I, LLC, against the town. However, that case is under appeal.

The commission voted to deny the most recent application “without prejudice,” meaning the applicant can re-apply at a future time.
